Name spelled incorrectly on the record.

Witness's name is Herberto (taken from the driver's license for spelling), but when the attorney asks for a spelling, the interpreter spells it Heriberto.  He is not a party to the lawsuit, just a witness. The jobsheet does not have a spelling on it.  What do you do?  Do you spell it with an "i" because that is how it was spelled on the record, or go by the driver's license?

Did the witness spell it in Spanish to the Interpreter or did the Interpreter spell it for the attorney without asking the witness for the spelling?    If the  the Interpreter spelled it without witness giving spelling, then I would put THE INTERPRETER:  H-e-r-i-b-e-r-t-o (as spelled).

If the witness spelled it for the Interpreter, then I would either just leave it how it was spelled or put (as spelled) after it.    I would not change the spelling because for all you know the driver's licence may be incorrect and the "i" is the correct way to spell.
