Approaching the bench

I am a freelance reporter and just took a trial.  Is there a parenthetical that I should put into the transcript for when there is a conversation at the bench, and then when we go back when the jury can hear?

I'm assuming by your question you mean a sidebar on the record discussion.

This if from Fedeal Rules of Civil Procedure in Florida:

Parenthetical for sidebar:

(The following proceedings were had before the Court and out of the hearing of the Jury.)

and when the proceedings resume in open court:

(The following proceedings were had before the Court and the Jury.)

Parenthetical for when the jury is out of the courtroom:

(The following proceedings were had before the Court and out of the presence of the Jury.)

Hope this helps.

Thank you so much!    -    vlwilliams 8/27/2010 8:53:38 PM | Flag

I say anything like the ones they have mentioned. It`s kind of a preference thing, but you should put something in there.

by conversation at the bench, do you mean a sidebar? if so, it is very important to indicate proceedings held outside the hearing of the jury and then proceedings that were held in open court in the presence of the jury as well as differentiating between whether you as the reporter were present at the sidebar or if you were not.

it`s not off the record if it`s on the record outside of the presence and hearnig of the jury; and that is exactly what should be indicated

(The following proceedings were held at the bench outside the presence of the jury.)(Proceedings were resumed in open court in the presence of the jury.) You can go on and on and on... Maybe you could ask someone who works in that district/county.

AND when the attys both go to the bench and whisper to the judge, No, we don`t need the reporter, (Usually about scheduling) -- (Proceedings were held at the bench outside the presence of the jury and court reporter.)
